If a loved one dies due to the wrongful or negligent act of another, the law establishes a separate statutory cause of action in favor of specified heirs. Under a wrongful death cause of action, the specified heirs are entitled to recover damages on their own behalf for the loss that they have sustained by reason of the victim’s death.

Wrongful death actions can arise from automobile accidents, workplace injuries, defective products, slip and falls or trip and falls, as well as generally unsafe conditions on property.

Some of the damages that can be pursued in a wrongful death action may include:

  • Medical expenses paid by the claimant on behalf of the decedent
  • Loss of society, enjoyment, and consortium of the decedent
  • Loss of potential earnings of the decedent
  • Any additional economic loss sustained due to the death of the victim

It may also be possible for the heirs to pursue a separate cause of action for emotional distress. Additionally, the law allows for the victim’s estate to pursue damages through a survival action. These damages descend through the estate and may include medical and other expenses incurred by the victim prior to death.
