Deposing a Difficult Expert

Wednesday, April 8th, 2009

defaultWhat follows is the partial video from a very difficult deposition.  I offer it as evidence of how an expert’s deposition can go poorly.  In fairness to the attorney taking the deposition, Joe Jamail, the expert for Monsanto (a large agriculture and chemical company) had been evasive and difficult for an extended period of time prior to the portion of the tape available.  And while I do not recommend or condone the conduct of any of those involved, had Joe knocked the block off of Monsanto’s expert or attorney, plaintiff attorneys everywhere would have rejoiced.
